The master agreement covering your use of the GettinPlace817 marketplace and auctions.
1. Agreement to these terms
GettinPlace817 (“GettinPlace,” “we,” “us”) operates an online marketplace and auction platform based in Fort Worth, Texas. By creating an account, browsing, bidding, buying, or listing an item, you agree to these Terms of Service and to the policies linked from our Legal Center, which form part of this agreement.
If you do not agree, do not use the platform. We may update these terms; material changes are posted here with a new effective date, and continued use after that date is acceptance of the updated terms.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your account information, for keeping your password confidential, and for all activity under your account.
One person may hold one account unless we approve otherwise in writing. We may refuse, suspend, or close accounts used for fraud, counterfeit sales, harassment, chargeback abuse, or repeated policy violations.
3. GettinPlace is a venue
We provide the venue, listing tools, payment processing, and dispute support. Sellers own their items and are the sellers of record. We do not take possession of items, inspect every item, or guarantee the accuracy of listings created by members.
Contracts of sale form directly between buyer and seller. We may step in to mediate disputes, reverse payouts, or remove listings, but we are not a party to the sale.
4. Fees
Listing is free. GettinPlace charges sellers a platform commission of 10% of the completed sale price, plus payment processing fees passed through by our payment provider. Full detail lives in the Marketplace Payment Terms.
Fees are deducted before payout. We will give notice before changing fees, and changes never apply retroactively to sales already completed.
5. Acceptable use
You agree not to list prohibited items, misrepresent authenticity or condition, shill bid, retract bids to manipulate price, transact off-platform to avoid fees, scrape the site, or interfere with its operation.
We may remove content, cancel bids or transactions, limit selling privileges, freeze payouts during an investigation, and suspend or ban accounts to protect members.
6. Content licence
You keep ownership of the photos and text you upload. You grant GettinPlace a worldwide, non-exclusive, royalty-free licence to host, display, resize, and promote that content in connection with operating and marketing the marketplace.
You confirm you have the rights to everything you upload, including photographs taken by others.
7. Disclaimers and liability
The platform is provided “as is” without warranties of any kind. To the maximum extent permitted by Texas law, GettinPlace is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the greater of $100 or the commission we earned on the transaction at issue.
Nothing in these terms limits liability that cannot lawfully be limited.
8. Governing law and disputes
These terms are governed by the laws of the State of Texas. Disputes follow our Dispute Resolution Policy, and any court proceeding takes place in Tarrant County, Texas.
